Oracle is in talks to hire Hurd as a top executive, according to a report in the . The exact nature of the title Hurd might take is unknown. The talks aren’t complete and the deal could still fall through. Oracle’s board still has to approve any appointment. But the trial balloon (a leak of information that could be viewed as a test of public sentiment on a matter) has clearly been floated. If there isn’t an outcry, Hurd might have himself a new job.

There may very well be no outcry. Hurd was forced to resign from HP after he admitted to a lapse in judgment about his relationship with a former HP marketing contractor. The contractor sued Hurd for sexual harassment, and the suit was settled out of court. But the investigation into the matter turned up lapses that led to Hurd’s resignation.

Oracle might inherit some baggage if it hires Hurd. It can’t profess to espouse the very highest of business ethics if it hires Hurd, who admitted to failing to live up to HP’s code of business standards. On the other hand, Hurd delivered stellar financial results for HP during a period of tumultuous change in the tech industry.

The deal isn’t necessarily a surprise because Larry Ellison, chief executive and founder of Oracle, was the primary defender of Hurd’s reputation in the wake of the scandal. HP would have plenty to worry about if Oracle hires Hurd. The two tech behemoths are fierce competitors, especially now that Oracle owns the former Sun Microsystems hardware business. Oracle earned $6.1 billion in its most recent fiscal year, while HP earned $7.7 billion. Yet Oracle is a much smaller company, with around 100,000 employees compared to HP’s 300,000.

Hurd’s intimate knowledge of HP’s future strategy could be very useful if he joins a business that will compete head-to-head with HP. The Journal reported that Ellision, 66, isn’t planning on giving up the top post at Oracle. He also has two co-presidents, Safra Catz and Charles Phillips. Ellison has given them considerable responsibility recently..

Last week, after the company assigned responsibility for Oracle’s global business units — something that Phillips previously supervised — to executive Bob Weiler.

Mr. Ellison continues to have final say over strategic decisions at Oracle and is responsible for the company’s engineering efforts. He is the company’s largest shareholder, owning about 23% of Oracle.

Following Mr. Hurd’s resignation from H-P last month, Mr. Ellison criticized H-P’s board for letting Mr. Hurd go. The board, “failed to act in the best interest of H.P.’s employees, shareholders, customers and partners,” Mr. Ellison wrote in an email to the New York Times.

Take-Two Interactive today that Gearbox Studios, the studio responsible for Borderlands, will finally pick up the pieces and finish developing the game.

It will be playable at the Penny Arcade Expo this weekend.

The original Duke Nukem struck a chord with rebellious young male gamers. The character from the original 1996 game, Duke Nukem 3D, was a studly, cigar-chomping, and highly weaponized badass. The game was extremely violent and it was controversial for its depiction of women as sex objects.

3D realms was finally in 2009 after working on the Duke Nukem Forever title for 13 years. The most recent sighting of the game in the wild was a released in 2007. The Journal reported that Gearbox began “finishing” the title in late 2009.

It should come as no coincidence that Take-Two also posted after the bell on Thursday — beating consensus expectations for revenue by about $50 million and raking in a $26 million profit — as a result of the success of its Red Dead Redemption release. Shares of Take-Two were up 9.5 percent today, to $9.69. They are likely in a better position to take a risk and bet on the Duke.

The Wall Street Journal was the to release the news earlier today. The game will ship in 2011 for the XBox 360, Playstation 3 and PC — though we’ve certainly heard that song and dance before. Nonetheless, with Gearbox and Take-Two finally cutting all the malarkey, gamers may finally be able to come get some.
